(a) Any person who shall be found loitering, eating, sleeping or wandering on the premises of another person or on the premises of any railroad company or other corporation, in the daytime, without permission of the owner or occupant of such premises or other lawful excuse therefor, shall be fined in any sum not exceeding five dollars ($5.00) for each offense.
(b) Any person who shall be found loitering, eating, sleeping or wandering on the premises of another person or on the premises of any railroad company or other corporation, in the nighttime, shall be prima facie guilty of trespassing, but proof that he is on such premises by permission of the owner shall be a complete defense, with the burden, however, on such person to prove same. Any person found guilty under this subsection shall be fined not less than five dollars ($5.00) nor more than fifty dollars ($50.00) or be imprisoned for not more than twenty (20) days, or both so fined and imprisoned for each offense.
