(a) Any person who may use the books, pamphlets, newspapers, periodicals, manuscripts and other literary property of the Lexington Public Library, or any part of same, either in the library building or on the premises of such library, or by withdrawing any such books, pamphlets, newspapers, periodicals, manuscripts or other literary property for private use elsewhere, under the rules and regulations of the board of trustees of the library, are forbidden to mark, mutilate or, in any manner, deface or injure or destroy such property; and any books, pamphlets, newspapers, periodicals, manuscripts, or other literary property, so used or withdrawn, shall be returned to the library in as good condition as when received, unavoidable wear and tear alone excepted.
(b) To any person violating the provisions of this section, the board of trustees of the library is authorized and empowered, in its discretion, to deny the privileges of the library for a period not exceeding one (1) year, including the privilege of withdrawing books from the library for private use; and, in addition thereto, any person so offending, and his surety on the library card of such person, shall be liable for the cost of repairing or replacing any of the property of the library so damaged or destroyed.
(c) Any person who shall be guilty of a second or subsequent offense under this section shall, in addition to the penalties prescribed above, as well as in addition to the penalties prescribed by general law, be liable to a fine of not less than one dollar ($1.00) and not more than twenty-five dollars ($25.00), to be recovered by appropriate proceedings in the district court; and all fines and costs collected for the violation of this section shall, when collected, be paid over to the board of trustees of such library.
