Any person violating this section [sections 14-3.1—14-3.4] shall be deemed to have committed a misdemeanor for each offense, and shall be subject to the following penalties, which shall not be mutually exclusive:
(1) Payment of a fine in the amount of not less than fifty dollars ($50.00), nor more than five hundred dollars ($500.00) and court costs;
(2) Imprisonment for not more than thirty (30) days; and
(3) Payment of a fee in the amount of fifty dollars ($50.00) to any Lexington-Fayette Urban County Government or not-for-profit program that removes graffiti and/or provides rewards for the reporting of graffiti violations. Such payment shall not be in lieu of the payment of a fine.
