Sec. 13-54. - Secondhand and junk dealers—Records, reports, retention of goods by secondhand dealers.
(a)   Every person, including a pawnbroker as defined in section 13-52, conducting business where junk, used auto parts or secondhand goods, wares or merchandise, materials or electronic devises including video games, CD's, or DVD's are purchased, for money or store credit, from an individual in the urban county shall comply with all provisions of this section as hereinafter set forth.
(b)   Every person carrying on any of the aforesaid businesses shall keep a register at his principal place of business, which shall contain the name, address and a visible description of the person or persons from whom any secondhand goods, wares or merchandise, or material, junk, used auto parts, or electronic devices including video games, CD's or DVD's are purchased; the date when received or bought; and a full description of said article, same to be in plain English handwriting or on computer disk if the store's records are maintained on a computer system; if any articles so left or deposited, pledged or purchased have engraved thereon any numbers words or initials, or contain any setting of any kind, the description recorded in said register shall show the numbers and initials:
(1)   Seller shall identify himself by name, address and date of birth by providing a valid operators license or similar identification.
(2)   All aforesaid material must be tagged by the buyer as to the page and line listing corresponding to the page and line listing in the register or on his computer.
(3)   No purchases or trades shall be made from any person under the age of eighteen (18).
(4)   The buyer shall require each person presenting merchandise to provide a thumbprint. The thumbprint shall be maintained by the buyer with other records of the transaction, and shall be made available to the division of police on demand.
(c)   It shall be the duty of any person to provide a copy of the register or the computer disk to the division of police on a daily basis and allow said officer to examine any and all articles herein belonging to or temporarily left in charge of such person up to a period of ten (10) business days; after that said material may be sold.
(d)   Any person violating any of the provisions of this section shall be guilty of a misdemeanor and upon conviction thereof shall for each offense be fined not less than five dollars ($5.00) nor more than one hundred dollars ($100.00) or confined in the county detention facility not more than thirty (30) days, or both so fined and imprisoned.
