(a) It is hereby made the duty of each person delivering ice by retail from truck or other vehicle, to provide each vehicle, while being so used, with accurate weighing scales of the type appropriate for the purpose of weighing ice; and the scales thus used shall at all times be subject to test by the building inspector.
(b) It shall be the duty of any person selling and delivering more than five (5) pounds of ice as set forth in section 13-42, upon request of any consumer or purchaser of ice, to weigh each quantity of ice of five (5) pounds or more so purchased in the presence of the purchaser thereof; and no charge for such ice shall be made in excess of the actual weight thereof.
(c) Any person who shall violate any provision of this section shall be fined upon conviction, not less than one dollar ($1.00) nor more than twenty-five dollars ($25.00) for each offense, which punishment shall be imposed upon the driver or actual person in charge of the vehicle from which the ice is sold and delivered, or upon the person owning and controlling and operating such vehicle.
