Sec. 13-25. - Same—Days and hours of auctions.
It shall be unlawful for any person to sell, dispose of or offer for sale in the urban county at public auction, or to cause or permit to be sold, disposed of or offered for sale in the urban county at public auction between the first day of October of any year and the first day of March in any succeeding year any gold, silver, plated ware, precious stones, watches, clocks, jewelry, bric-a-brac, crockery, glassware and leather goods, whether the same shall be his own property, or whether he sells the same as agent or employee of others; however, this section shall not apply to judicial sales or sales of executors or administrators or to sales by or on behalf of licensed pawnbrokers of unredeemed pledges in the manner provided by law; and further, auctions may be held for the purpose of closing out or liquidating a business in good faith between the first day of February and the thirtieth day of September of any year; and further, auction sales may be held until the hour of 9:00 p.m. between the first day of February and the thirtieth day of September of any year, but only for the purpose of closing out or liquidating a business in good faith.
It shall be unlawful for any person to sell, dispose of or offer to sell at public auction from the second day of March until the thirtieth day of September, both inclusive, in any year, between the hours of 6:00 in the evening and 8:00 the following morning any gold, silver, plated ware, precious stones, watches, clocks, jewelry, bric-a-brac, china, crockery, glassware and leather goods; but this section shall not apply to judicial sale or sales which may be made pursuant to the order of any court of competent jurisdiction.
It shall be unlawful for any person to act as by-bidder or what is commonly known as a "capper" or "booster" at any such auction or place or to offer or make any false bid or to offer any false bid to buy or pretend to buy such article sold or offered for sale at any such auction sales.
Any person violating any of the provisions of this section shall upon conviction be fined in any sum not exceeding one hundred dollars ($100.00) or confined in the city jail for a period not exceeding fifty (50) days or both so fined and imprisoned within the discretion of the court or jury.
