The County Budget Commission, consisting of the County Judge, the County Attorney, and one (1) member appointed by the Fiscal Court under the provisions of Section 11.02 of this Charter, shall continue in full force and effect after the effective date of this Charter until such time as the General Assembly of Kentucky, or an appropriate state court, shall decide that, for purposes of budgeting, the Lexington-Fayette Urban County Government is not a county under the terms of the law governing county budgets. Until such time, the Budget Commission of the Merged Government shall be responsible only for forwarding the annual operating budget and capital improvements budget to the proper state officer under law, and shall not have any responsibility for the preparation, adoption or implementation of said budgets.
