Sec. 5.05. - Veto Powers.
The Mayor is authorized to approve or disapprove ordinances and resolutions adopted by the Council, except ordinances and resolutions relating to:
A.   The revision or amendment of this Charter;
B.   The decennial redistricting of council districts;
C.   The operation and internal affairs of the Council;
D.   The authorization or conduct of investigations by the Council as provided in Section 4.08 of this Charter.
Every ordinance or resolution adopted by the Council over which the Mayor has veto power shall be presented to the Mayor for his consideration. If he approves the ordinance or resolution, he shall sign it and it shall become effective according to the terms thereof. If he disapproves, he shall return the same to the Council without his signature accompanied by a message indicating the reasons for his disapproval. Any ordinance or resolution so disapproved shall become effective when, subsequent to its return to the Council by the Mayor, it shall be adopted by a roll-call vote of three-fifths ( 3/5 ) of all members of the Council. The mayor shall approve or disapprove all ordinances and resolutions within ten (10) days of delivery of said ordinance or resolution by the Council to his office for consideration. Should the Mayor fail to approve or disapprove within the ten (10) days limitation, said ordinance or resolution shall become effective according to the terms thereof.
In addition to the aforementioned veto powers, the Mayor may reduce or disapprove the sum of money appropriated by any one or more items, or parts of items, in any ordinance appropriating money. All such reductions or disapprovals shall be made within the time limit prescribed for vetoing ordinances generally, and shall be returned to the Council accompanied by a message indicating the reasons for such reductions or disapproval. The one (1) or more items or parts of items reduced or disapproved by the Mayor shall be void to the extent any such items or parts of items have been reduced or disapproved, unless any such item or parts of items so reduced or disapproved shall be restored to the ordinance and become effective by a roll-call vote of three-fifths ( 3/5 ) of the members of the Council.
Annotation—See Charter Section 4.07 and KRS 67A.070(4) relating to mayoral veto power. See also Hacker v. Baesler, Ky., 812 S.W.2d706 (1991), which held this power does not extend to zone map amendments.
