Sec. 4.06. - Vacancies.
The office of a district council member shall become vacant upon the death, resignation, or ineligibility due to change of residence to a place outside the boundaries of the district from which he or she was elected as defined under the provisions of this Charter. When a district council office becomes vacant, the Mayor of the Urban County Government shall, within thirty (30) days of establishing that a vacancy exists, appoint a successor to fill the vacancy for the remainder of the term. The Council may, within fifteen (15) days of such an appointment, disapprove the appointment of the Mayor by a vote of two-thirds ( 2/3 ) of its members. Upon a vote of disapproval, the Mayor shall continue to appoint a successor to fill the vacancy in question. In no case shall the Mayor appoint any individual to fill a specified district council vacancy who has been disapproved by the Council to fill said vacancy.
The office of an at-large council member shall become vacant upon the death, resignation, or ineligibility due to a change of residence to a place outside the territory of the Lexington-Fayette Urban County Government. When an at-large council office becomes vacant less than two (2) years prior to the filing date of the next general election for at-large seats on the Council, the Mayor shall, subject to the provisions and limitations governing vacancies in a district council seat, appoint a successor to fill out the remainder of the term of the at-large member. When an at-large council office becomes vacant more than two (2) years prior to the filing date of the next general election for at-large seats on the Council, the Mayor shall, subject to the provisions and limitations governing vacancies in a district council seat, appoint a successor to fill out the remainder of the term of the at-large member until the installation of the Council following the next general election of any member of the Council. In the event such an appointment is made, the Mayor shall call a special election to fill the remaining term of the at-large vacancy to be conducted on the date and time of the next general Urban County Government election in which any seat on the Council is at stake.
