(a) Whenever a vacancy in a division of fire and emergency services or division of police position is to be filled, the chief in whose division the vacancy occurs will notify the appointing authority and the director as far in advance as possible. The chief may request, on a form prescribed by the director, a certification to him of the eligibles in the particular class wherein the vacancy exists. Examinations may be scheduled in advance of future vacancies.
(b) The director shall certify to the chief in whose division the vacancy exists the eligibles who are ranked highest in the numerical rankings, and the chief may schedule a preemployment interview with those eligible for appointment. Failure to appear at a preemployment interview without furnishing satisfactory explanation to the chief shall warrant the director's removal of an individual from the eligible list.
(c) A person on any eligible list may waive consideration for appointment within four (4) working days after being notified of the certification, on a form prescribed by the director. If the reason for a waiver is deemed appropriate and sufficient by the director, it may be approved for a stipulated period not to exceed sixty (60) days. A waiver will count as a certification against the individual. No more than one (1) waiver per eligible will be permitted during the lifetime of the list.
