Sec. 2-3.1. - Procedures for petitioning, filing and certifying applicants for nomination for offices of mayor and council member.
Pursuant to article 12 of the Urban County Charter, procedures for petitioning, filing and certifying applicants for nomination for the offices of mayor and council member shall be as follows:
(1)   Each applicant for nomination shall, not later than the last Tuesday in January preceding the day of the primary election no later than 4:00 p.m. local time, file with the county clerk a petition signed by at least one hundred (100) voters who are legally qualified to vote for the candidate, in the following form:
"We the undersigned, qualified voters of the Urban County Government of Lexington, Fayette County, Kentucky, and residing each at the place indicated opposite his/her name, do hereby request that the name of ________ be placed on the ballot as that of an applicant for nomination for the office of ________, at the primary election to be held in our urban county on the first Tuesday after the third Monday in May. We know the applicant to be a qualified voter of the urban county and a person of good character, and he/she is, in our judgment, qualified for the duties of the office.

The petition shall be verified by the affidavit of some person as to the genuineness of the signatures and addresses of the signers. No voter shall sign more than one (1) petition with reference to each office that is to be filled. If any voter signs more then one (1) petition of applicants for nomination for mayor or district council member, or signs the petitions of more applicants for nomination for at-large council members than the number of at-large council members to be elected, the name of that petitioner shall not be counted as a valid name on any petition.
(2)   Immediately upon the expiration of the time for filing petitions, the county clerk shall have published as provided in KRS chapter 424, the names of the persons as they will appear upon the primary ballot labels, and shall thereupon cause the primary ballot labels to be printed.
(3)   Subsection (2) of this section shall not apply if it appears, immediately upon the expiration of the time for filing petitions, that there are not more than two (2) applicants for nomination as mayor, or not more than two (2) applicants for nomination for district council member in any council district, or not more applicants for nomination for at-large council member than twice the number of at-large council members to be elected. In those cases, the applicants for mayor and the applicants for council member shall thereby be nominated, and no primary election shall be held for nomination for those offices.
(4)   The names of the applicants for each nomination shall be placed on the voting machine as provided by law. Above the names of the applicants for nomination for mayor or district council member shall be printed the words, "Vote for one," and above the names of the applicants for nomination for at-large council members shall be printed the words, "Vote for three." No party designation or emblem of any kind, nor any sign indicating any applicant's political belief or party affiliation, shall be used.
(5)   The votes shall be counted as provided in the general election laws, and after being so counted the result shall be published as provided in KRS chapter 424.
(6)   Voters shall be permitted at any regular election to cast write-in votes for any person according to the procedure prescribed by law for write-in votes generally. As used in this subsection, "regular election" shall mean the general election held pursuant to section 148 of the Kentucky Constitution on the first Tuesday after the first Monday in November.
