Sec. 21-36. - Payment of accumulated sick leave upon retirement or death.
(a)   Upon service retirement under the county employees retirement system, city employees pension fund, or the policemen and firemen's retirement fund, or upon retirement under social security after completion of five (5) years of service with the urban county government, or upon death, all classified civil service employees shall be compensated for all accumulated sick leave in a lump sum payment. However, when a classified civil service employee who has a minimum of twenty (20) years of service with the urban county government withdraws from service for any reason, including disability retirement, he shall be compensated for all accumulated sick leave in a lump sum payment.
(b)   Upon disability retirement, all classified civil service employees who have less than twenty (20) years of service with the urban county government shall be compensated for all accumulated sick leave as follows:
(1)   An employee otherwise eligible for service retirement at the time of disability retirement may elect to supplement his or her disability pension with any accrued sick leave so that the total biweekly income of both equals the biweekly income, for federal and state income tax purposes, received by the employee immediately prior to the injury or disability which prompted retirement, or may elect to be compensated in a lump sum as in subsection (a), above.
(2)   An employee not otherwise eligible for service retirement at the time of disability retirement shall be compensated for accumulated sick leave as a supplement to his or her disability pension so that the biweekly total of disability retirement benefits plus sick leave payment equals the biweekly income, for federal and state income tax purposes, received by the employee immediately prior to the injury or disability which prompted retirement.
(c)   All compensation for accumulated sick leave shall be computed on the basis of accumulated hours at an hourly rate which reflects base salary and, if applicable, longevity pay and specialist pay, but which shall not include educational or training incentive payments, uniform allowances or other payments not enumerated above.
