(a) In the event that any person holding a permit issued pursuant to this chapter violates the terms of the permit or violates any provision of this chapter in such a manner as to pose a threat to the public health, welfare, or safety so as to be materially detrimental to the public welfare or injurious to property or improvements, the permit may be suspended or revoked and an order issued to stop all work pursuant to the permit by the director of the division of waste management, division of water quality, division of environmental policy or the commissioner of environmental quality as appropriate.
(b) An appeal from a stop work order issued pursuant to subsection (a) may be made to Fayette District Court within thirty (30) days of the date the order is issued. The appeal shall be initiated by the filing of a complaint and a copy of the order in the same manner as any civil action under the rules of civil procedure.
(c) A judgment of the Fayette District Court may be appealed to the circuit court in accordance with the rules of civil procedure.
