(a) No person shall create, cause, continue or authorize an illicit discharge except as authorized by subsection (b).
(b) The commencement, establishment, or continuance of any illicit discharge is prohibited except as authorized by this subsection (b). The following discharges are exempt from discharge prohibitions established by this division for illicit discharges unless they create an erosion problem that is avoidable using reasonable precautions through energy dissipating devices such as, but not limited to, splashblocks:
(1) Potable water line flushing or other potable water sources, landscape irrigation or lawn watering, diverted stream flows, rising ground water, ground water infiltration to storm drains, uncontaminated pumped ground water, foundation or footing drains (not including active groundwater dewatering systems), crawl space pumps, air conditioning condensation, springs, non-commercial washing of vehicles, natural riparian habitat or wet-land flows, swimming pool drainage (if dechlorinated - to less than 1.0 part per million chlorine), fire fighting activities.
(2) Discharges specified in writing by the authorized enforcement agency as being necessary to protect public health and safety.
(3) Non-toxic dye testing contingent upon providing written notification to the authorized enforcement agency prior to the time of the test.
(4) Non-storm water discharges permitted under a KPDES permit, waiver, or waste discharge order issued to the discharger and administered under the authority of the Kentucky Division of Water, provided that the discharger is in full compliance with all requirements of the permit, waiver, or order and other applicable laws and regulations.
(5) Other discharges containing de minimis pollutants if advance written authorization is provided by the director, division of water quality.
(6) Discharges authorized by the director, division of water quality, where necessary to protect public health or welfare in an emergency situation on a case-by-case basis.
