(A) All shade trees in the city six inches in diameter and two feet above the ground, which are situated between any sidewalk and curb in any street in the city, or which are situated upon any property in the city so near the line of the street that the limbs or boughs thereof shall overhang the sidewalks of the street, shall be trimmed by the owner of the lot adjoining the street wherein the shade trees may be situated or of the lot upon which the shade trees shall be situated so that the lowest foliage thereof shall be at least ten feet above the surface of the street, and shall be trimmed in accordance with the directions of the Street Commissioner. These trees shall be trimmed once each year if deemed necessary by the Street Commissioner not later than May 1 of each year.
(B) Any person owning any real estate in the city, where any shade trees are growing in the street as provided in division (A) of this section, who shall fail to keep the shade trees trimmed as required in division (A) above shall, upon conviction thereof, be punished as provided in § 101.999, and upon failure to so trim the trees as provided in division (A) of this section, after five days’ notice from the Street Commissioner, the Street Commissioner shall trim, or cause the trees to be trimmed as provided in the division, and the costs, charges and expenses thereof shall be charged against the owner of the property and shall be collected by suit before the Mayor of the city for that purpose.
