§ 151.06  RIGHT OF APPEAL.
   (A)   All persons aggrieved by a decision of the Building Commissioner or his or her representative regarding the interpretation or decision based on this chapter shall have the right of appeal.  An appeal must be made within 15 days from the date of any decision made by the Building Commissioner or his or her representative, by request in writing to the Building Commissioner within that period of time, with the basis and need for the appeal.
   (B)   The person who is aggrieved by a decision of the Building Commissioner regarding § 151.06, §§ 151.42 through 151.44, and §§ 151.55 through 151.63 may appeal the same to the County Board of Commissioners within 15 days from the date of the decision complained of.
      (1)   The Board of Commissioners will set a hearing within 15 days after receiving notice of the appeal and notify the petitioner of the date, time, and place.
      (2)   The Board of Commissioners may conduct the hearing or appoint a designated representative to conduct the hearing and report the recommendations and findings to the Board of Commissioners for final approval.
   (C)   Any person or association who is aggrieved by any decision of the Building Commissioner or his or her representative in violation of fire and building codes, §§ 151.20 through 151.25, may appeal the decision within 15 days from the date of that decision to the Board of Construction Review.  The Board of Construction Review will then notify the petitioner within 15 days after receipt of the appeal of the date, time, and place of the hearing to be conducted regarding the interpretation of the fire and building codes.
      (1)   The Board of Construction Review shall consist of five people appointed by the County Board of Commissioners for a term of three years.  In order to provide for staggered terms, initial appointment to this Board shall be as follows:
         (a)   Two members for a three-year period;
         (b)   Two members for a two-year period; and
         (c)   One member for a one-year period.
      (2)   To qualify for membership on the Board of Construction Review, an individual candidate must have a working understanding of fire prevention and the building safety code laws of the state, and/or be willing and able to develop and understand the fire prevention and building safety code laws of the state.  No more than two members may be registered contractors pursuant to this chapter.
