7-1-8: MOTORIZED SKATEBOARDS:
   A.   Definition: For the purposes of this section, "motorized skateboard" means any device that has a deck or platform on which a person may stand or sit, with two (2) or more wheels, and that is self-propelled by any type of motor or engine; provided, however, that the term "motorized skateboard" shall not include the following: 1) a motor vehicle 1 ; 2) a motorcycle 2 ; 3) a motor driven cycle 3 ; 4) a motorized pedalcycle 4 ; or 5) a motorized wheelchair 5 or other device designed and used to transport a person with a disability.
   B.   Limitation On Use: With the exception of authorized employees and officers of the Village of Lake Zurich, United States Postal Service employees, and other authorized governmental employees, no person shall operate or ride a motorized skateboard on or within any of the following places within the Village: private streets and rights-of-way, public streets and rights-of-way, public sidewalks, public parking lots or areas, public parks, and any other public property.    C.   Fine; Impoundment And Redemption: Any person violating this section may be subject to a citation and imposition of a fine pursuant to the general penalty provisions set forth in section 1-3-2 of this Code. Additionally, any person who has been issued three (3) or more citations for violations of this section within any twelve (12) month period will be required to surrender, at the time of issuance of a citation, the motorized skateboard to the police officer or other authorized official who issues the citation. The surrendered motorized skateboard will be impounded and held by the Lake Zurich Police Department and will be returned to its owner only after one of the following sets of conditions has been met: (Ord. 2010-02-697, 2-1-2010)
      1.   The person against whom the citation was issued shall have paid or caused to be paid: a) all outstanding fines and b) the fees and costs of the Village in the amount pursuant to title 13, chapter 1, "Fee Schedule", of this Code; or (Ord. 2002-12-205, 12-2-2002; amd.       2.   The person against whom the citation was issued shall have: a) paid or caused to be paid all outstanding fines and b) presented to the Village proof that a determination of not guilty was made for the cited offense. (Ord. 2002-12-205, 12-2-2002)
   D.   Payments To Avoid Prosecution: A person charged with a violation of this section may avoid prosecution by paying to the Village the amounts pursuant to title 13, chapter 1, "Fee Schedule", of this Code for each violation within the time specified.
After thirty (30) days, the fine must be paid in full or a court appearance will be required. This subsection shall not affect the redemption fee set forth in subsection C1 of this section. (Ord. 2002-12-205, 12-2-2002; amd. Ord. 2018-12-279, 12-3-2018)
