3-2-1: AMUSEMENTS:
   A.   Application For License: Each application for a license to own, promote, operate, conduct, manage or sponsor an amusement or to own, lease or maintain a coin operated amusement device for public use shall include, in addition to the requirements of sections 3-1-6 and 3-1-7 of this title, the square feet of the premises where the amusement is to be presented or performed and the location where the coin operated amusement device is to be used.    B.   Investigations, Inspections:
      1.   In addition to the investigations, if any, conducted pursuant to chapter 1 of this title, the fire chief, the police chief, and the director of building and zoning shall make or cause to be made such investigations as they deem necessary to determine whether the applicant's proposed operations and premises comply with all the applicable regulations of this code and other village codes, ordinances and regulations relating to amusements, fire prevention and building and zoning. Said village officials shall indicate on the application for a license the results of their investigations and their approval or disapproval of said application.
      2.   In addition to any inspection conducted pursuant to chapter 1 of this title, the fire chief, the police chief and the director of building and zoning shall inspect as often as they deem necessary the operations and premises of any licensee under this title to determine whether all applicable provisions of this code are being met.    C.   Location Restrictions: No license shall be issued to any person who intends to present or perform any amusement on any premises within five hundred feet (500') of any church, hospital or building used exclusively for educational purposes; provided, however, that if any such premises were designed for the purpose of presenting an amusement and were built prior to the establishment of such church, hospital or building used exclusively for educational purposes, then this restriction shall not apply; and provided further, however, that this restriction shall not apply to a church, hospital or building used exclusively for educational purposes that has acquired a license to present or perform an amusement on its premises.    D.   Gambling Prohibited: No person shall gamble, bet or partake in games of cards or dice for any purpose in any building or hall used for amusement purposes. This restriction shall not apply to any bingo games, the sale of lottery tickets on a location licensed by the state, or to locations holding a video gaming license pursuant to 230 Illinois Compiled Statutes 40/1 et seq.    E.   Coin Operated Amusement Devices:
      1.   No coin operated amusement devices shall be operated for use by the general public without the prior written consent of the village manager. The village manager shall set the maximum number of such devices that may be operated in any one establishment, which number shall be based on the amount of space available in such establishment, the location of the establishment, the other uses and activities located within and in the vicinity of the establishment, and such other matters affecting the public health, safety, and general welfare as the village manager deems appropriate. The number of coin operated amusement devices that may be operated in any single establishment shall be limited as follows; provided, however, that the board of trustees may approve a greater number by motion, resolution, or ordinance: (Ord. 95-05-738, 5-15-1995; amd.       2.   No coin operated amusement device shall offer, allow, or award any monetary reward or prize.
      3.   No gambling shall be permitted in conjunction with any coin operated amusement device or in any establishment in which any such device is located.
      4.   No coin operated device shall offer, allow, or award more than six (6) free replays in total, howsoever accumulated. Nor shall any such device be equipped with any "knock off" or similar button or device that can release or cancel any free replay. (Ord. 95-05-738, 5-15-1995)
   F.   Theatricals: An application for a license to produce, present, conduct or sponsor a theatrical shall include, in addition to the requirements of sections 3-1-6 and 3-1-7 of this title, the seating capacity of the premises where it is intended to produce, present, conduct, or sponsor the theatrical.
   G.   Circuses And Carnivals: An application for a license to operate, manage or conduct any carnival, menagerie, sideshow or circus shall include, in addition to the requirements of sections 3-1-6 and 3-1-7 of this title, the seating capacity of the place where such amusement is to be performed or exhibited.
   H.   Cabarets And Nightclubs: No license to operate or conduct a public dance shall be issued to a person who is not a person of good moral character or to a corporation or organization which is not represented in the village by a person of good moral character.
   I.   Public Bathing Beaches: No person shall operate a public bathing beach where swimming is permitted unless there is on duty at all times such place is open for business a lifeguard station facility for lifeguard use only and a lifeguard attending that facility. The lifeguard shall have no other duties at such place other than as a lifeguard.
   J.   Parades: No person shall conduct any parade on any public street, alley, or other public way or place in this village unless a permit therefor is first obtained. (Ord. 93-12-627, 12-6-1993)
   K.   Video Gaming: Video gaming, as defined in the Illinois video gaming act, 230 Illinois Compiled Statutes 40/5, is permitted to the extent allowed by statute and by this code. (Ord. 2014-4-963, 4-7-2014)
