§ 32.01 SCOPE; PURPOSE.
   (A)   These rules and regulations, upon their effective date after adoption by the Joint Powers Board and approval by the City of La Crescent and Township of La Crescent, hereby shall be the controlling rules and regulations of the Fire Department and supersede any and all inconsistent or conflicting prior rule, regulation, by-law, policy or any other directive whether written or verbal. All such existing rules, regulations and by-laws, policies or directives shall automatically become null and void upon the effective date of these rules and regulations. All firefighters shall familiarize themselves with and abide by all Fire Department policies, general rules, regulations and code provisions concerning the La Crescent Fire Department, hereinafter "Department."
   (B)   It is the purpose and mission of the La Crescent Fire Department to minimize loss of life and property for the La Crescent community from fires, natural disasters, life threatening situations and to assist other emergency agencies.

§ 32.02 DEFINITIONS. 
   Unless the context clearly indicates otherwise, the words, combination of words, terms, and phrases as used in these rules and regulations shall have the meanings set forth in the following definitions.
   EMPLOYEE. All firefighters and emergency first responders, and all officers of the Department, albeit not for any collective bargaining or Public Employment Labor Relations Act purposes, but among other purposes, recruitment, workers compensation and withholding from compensation are hereby deemed EMPLOYEES.
    EMPLOYEE IN GOOD STANDING.  Any employee of the Department, who continues to meet all training, participation and health requirements of these Department rules and regulations as amended.
   FIREFIGHTER.  Any permanent, non-probationary employee of the Department, including all officers.
   GOVERNING AUTHORITY.  The City Council of the City of La Crescent or the Joint Powers Board to the extent of the powers delegated by the Joint Power Agreement of August 15, 1988 as amended.
   INACTIVE STATUS.  Not in compliance with training, participation or health requirements of these Department rules and regulations as amended.   An inactive employee of the Department is not an employee in good standing.
   OFFICER.  A firefighter who has been duly appointed to and continues in a supervisory capacity in the Department as provided in these provisions, including the Chief, and designated officer supervisory positions as may be recommended by the Chief and approved by the Governing Authority.
   PROBATIONARY FIREFIGHTER. A firefighter who has not yet completed the prescribed probationary period in accordance with these Department rules and regulations as amended.

§ 32.03 DEPARTMENT ORGANIZATION.
   (A)   The heretofore established and ongoing Department in the city is hereby affirmed in its continuation for the benefit of the city specifically, and the community generally, to the extent that the services thereof are contracted for, as the case may be, and pursuant to Joint Powers Agreement entered into by the city for the rendition of fire suppression services and response to emergencies, to enforce city fire codes, investigate fires, and provide fire safety education to the public.
   (B)   The Department shall be administered by the Fire Chief and such other officers as provided in these rules and regulations. The Department shall have as many firefighters as the Governing Authority deems necessary, provided the total number of positions in the Department including officers, firefighters and probationary firefighters shall not be less than 20 nor more than 30. The Governing Authority shall hire firefighters in accordance with these rules and regulations and other laws and applicable to hiring. Reduction or increase of the personnel of the Department shall be determined by the Governing Authority in its sole discretion upon available data including consideration of any relevant information such as recommendation of the Chief as the Governing Authority deems necessary in order to promote the efficiency of the Department. The Department chain of command shall be defined in the Department rules and regulations.
