§ 72.10 LIMITATION OF COMMERCIAL VEHICLES PARKED WITHIN RESIDENTIALLY ZONED DISTRICTS.
   (A)   The parking of any commercial vehicle, semi-trailer or trailer upon any lot, land, street, right-of-way, or shoulder thereof, for a period of time exceeding one hour is prohibited, except in emergency situations or for such length of time as may be necessary for the pickup, loading, unloading or delivery of materials and/or passengers in any residentially zoned area. A copy of the town zoning map is available for public inspection in the Office of the Town Clerk. This prohibition shall be enforced by the Code Enforcement Officer or his designated representative, by written complaint from a civic or homeowners’ association representing a subdivision in which such violation is alleged to have occurred, or by written complaint by at least one resident living within 1,000 feet of the alleged prohibited conduct. It is further provided that this prohibition shall not apply to lots larger than two acres, provided adequate screening of such alleged prohibited conduct is undertaken.
   (B)   The intent of this section is to limit the size and weight of commercial vehicles, semi-trailers or trailers in residential areas and:
      (1)   To eliminate the visual blight created by large commercial vehicles, semi-trailers or trailers being indiscriminately parked in residential areas for long periods of time;
      (2)   To minimize physical damage to publicly maintained rights-of-way;
      (3)   To protect property values and character of property within residential developments;
      (4)   To reduce traffic congestion;
      (5)   To protect children from traffic injuries.
   (C)   For the purpose of this section, a COMMERCIAL VEHICLE is defined as a vehicle used or maintained for the transportation of persons for hire, compensation or profit, or designed, used or maintained primarily for the transportation of property; or a vehicle having a tare weight exceeding five tons (10,000 pounds), or a vehicle having more than two axles, or a vehicle greater than ten feet in height. Construction equipment and farming equipment of any type are included in the definition of COMMERCIAL VEHICLE. SEMI-TRAILER means a vehicle designed for carrying persons or property used in conjunction with a motor vehicle, and so constructed that some part of its weight and that of its load rests upon, or is carried by another vehicle. TRAILER means a vehicle designed for carrying persons or property on its own structure and being drawn by a motor vehicle, and so constructed that no part of its weight rests upon any other vehicle.
