It is the purpose of this chapter to provide a sanitary and satisfactory method for the preparation, collection and disposal of municipal solid waste and refuse and for the maintenance of public and private property in a clean, orderly and sanitary condition for the peace, health and safety of the community. The system of collection and disposal of solid waste and recyclables by the City of Kenton is hereby declared a public utility.

As used in this chapter:
(d) "Bulk items" means items of solid waste that cannot be enclosed or retained in the ninety-six-gallon refuse cart or a thirty-gallon bag not exceeding forty pounds. Bulk items shall include, but not be limited to, furniture, bedsprings, wrapped mattresses, carpet not exceeding four feet long, tied, and not exceeding forty pounds, large toys, swing sets (disassembled not exceeding four feet in length), and comparable material determined by the City. Bulk items do not include earth, sand, brick, stone or other building materials.a
(b) "Commercial/industrial unit" means all units other than residential units as defined above are excluded from receiving solid waste and recycling services through the City of Kenton. This includes, but is not limited to business and industrial establishments, schools, churches, public, private and charitable institutions, and dwelling places with more than three dwelling units.
(e) "Recyclables" means (i) paper, including newspapers, magazines, advertisements, mail, office paper, and phone books, (ii) cardboard and paperboard not exceeding two feet by two feet and flattened, including cereal, cake, and rice boxes, (iii) food and drink glass bottles and jars (clear or colored); (iv) #1 and #2 plastic bottles and jugs, including milk jugs, beverage bottles, shampoo bottles, laundry jugs, and household cleaning bottles, and (v) aluminum and steel food cans, including food, beverage, and pet food cans and steel or bi-metal (tin) food, soup, coffee and pet food cans. The term "recyclable material" does not include automotive product containers, chemical/pesticide containers, bowls, buckets, feed bags, flower pots, microwave/fast food trays, Styrofoam, toys, mirrors, ceramics, light bulbs, window glass, dishes, china, paint cans, aerosol cans, pots, pans, hangers, batteries or appliances, plastic bags, and all #3 though #7 plastics.
(a) "Residential unit" means one, two or three residences under a common roof. A place of abode of a person or persons that received either directly or indirectly, either water or sewage service, and being subject to mandatory solid waste/garbage and refuse service provided by or through the City of Kenton under this chapter.
(c) "Solid waste" means such unwanted residual solid or semisolid material generated by residential premises located within the City of Kenton and by City-operated facilities, excluding earth or material from construction or demolition operations, and includes, but is not limited to, kitchen wastes including cans, bottles, household food, accumulations of animal food and vegetable matter attendant in preparation, cooking and serving of food, and general household trash and refuse. "Solid waste" does not include any material that is an infectious waste, hazardous waste, or unacceptable waste. "Unacceptable waste" includes hazardous waste, construction material, car parts, tires, vehicle batteries, paint and other liquids, pesticides, large dead animals, rocks, dirt, stones, brick, concrete, items over four feet long or wide, items weighing over seventy pounds, items containing Freon, and similar items that are deemed improper for collection and disposal. "Hazardous waste" includes, but is not limited to, any amount of waste listed or characterized as hazardous by the United States Environmental Protection Agency or any state agency pursuant to RCRA, and including future amendments thereto, and any other applicable law.

Any residential unit within the City of Kenton shall be subject to mandatory solid waste collection and disposal and recycling under this chapter and the City, through its agents and contractors, shall be the exclusive provider of solid waste collection and disposal and recycling for residential units. Any commercial/industrial unit are open to other private haulers on a contractual basis for service subject to the rules and regulations of the City of Kenton and the Hardin County Health Department and are not included in the solid waste services provided under this chapter; provided, however that any commercial/industrial unit is still subject to Sections 1060.04

(a) Domestic Solid Waste. Solid waste shall be drained of all liquid.
(b) Commercial Solid Waste. Solid waste from hotels, clubs, restaurants, institutions and other establishments for group eating, other than private residences, need not be wrapped. Solid waste resulting from the handling, preparation or distribution of food and food products for consumption off the premises from such establishments as markets, commission houses, grocery stores, fruit and vegetable stands, bakeries, canneries, butcher shops and similar establishments need not be wrapped. Such unwrapped garbage and waste shall be placed in containers in such a manner that public nuisances will be prevented.
(c) Recyclables. For plastic bottles and jugs and aluminum and steel food cans, remove all lids and rinse thoroughly. No food or liquids shall be left in containers. Cardboard and paperboard must be cut or folded smaller than two feet by two feet, flattened, and all plastic packaging and Styrofoam removed. No wet paper of boxes shall be accepted and no cardboard or paperboard with food residue.

No owner, tenant, or lessee of any residential unit shall permit any solid waste, garbage or rubbish to accumulate on his or her premises unless it is placed and maintained as provided herein.
(a) Containers Required. Each residential unit shall be provided one ninety-six-gallon solid waste cart and one sixty-five-gallon recyclables cart. On the regularly scheduled collection day, residents or owners shall place the solid waste cart and recyclables cart behind the curb line in front of the residential unit. All solid waste shall be stored in such solid waste cart and all recyclables shall be stored in such recyclables cart. Any solid waste that shall not fit into the ninety-six-gallon solid waste cart must be placed in a trash bag not to exceed thirty-gallons of sufficient quality to hold the contents contained therein without breaking and be tied at the top or sealed with a twist-tie. The resident or owner shall be responsible for maintaining the solid waste cart and recyclables cart and all such carts must remain at the address where they are delivered. Any resident or owner will be charged a fee of seventy dollars ($70.00) for the replacement of any cart, which will be added as a separate charge to such user's monthly bill. Residential units may request an additional solid waste cart at the cost of three dollars and fifty cents ($3.50) per month and an additional recyclables cart at the cost of three dollars ($3.00) per month, which monthly fees will be added to the applicable monthly flat rate set forth in Section 1060.06

(b) Bulk Items. Bulk items shall be placed behind the curb line prior to the time of regular collection of the day of collection.
(c) Placement and Removal of Containers. No resident or owner of a premises or its agent shall permit the placement of any solid waste cart or recyclables cart on any street, curb side, or public right-of-way for collection and disposal thereof any earlier than 4:00 p.m. the day before the scheduled collection day and such resident or owner must remove said carts no later than 6:00 p.m. the day after the scheduled collection day. Any cart left in violation of this removal schedule will be removed and placed at the front of the residence by City employees. Repeated violations of this section shall be billed a twenty dollar ($20.00) administrative fee per violation to the resident's next water bill. Failure to provide payment of these additional charges will result in termination of water service at such premises.

Effective July 1, 2023 and until further passage of amendment to the rates set forth in this section, the fee for collection, removal and disposal of residential solid waste and recyclables shall be a monthly charge as follows:
(a) Senior Citizen Rate. Weekly sixty-five-gallon refuse cart with one bulk item per week, with every-other-week sixty-five-gallon recyclable material cart, per residential dwelling, and no additional trash bags allowed under the discounted senior citizen rate:
(1) Year One - July 1, 2020 - June 30, 2021: $15.60
(2) Year Two - July 1, 2021 - June 30, 2022: $15.60
(3) Year Three - July 1, 2022 - June 30, 2023: $16.06
(4) Year Four - July 1, 2023 - June 30, 2024: $16.03
(5) Year Five - July 1, 2024 - June 30, 2025: $16.51
(b) Non-Senior Citizen Rate. Weekly ninety-six-gallon refuse cart with one bulk item per week, with every-other-week sixty-five-gallon recyclable material cart, per residential dwelling, and up to three additional thirty-gallon bags of trash beside the refuse cart not to exceed forty pounds per bag:
(1) Year One - July 1, 2020 - June 30, 2021: $19.20
(2) Year Two - July 1, 2021 - June 30, 2022: $19.20
(3) Year Three - July 1, 2022 - June 30, 2023: $19.78
(4) Year Four - July 1, 2023 - June 30, 2024: $19.88
(5) Year Five - July 1, 2024 - June 30, 2025: $20.50
For purposes of this section, the senior citizen rate shall be available to any requesting residential unit that has a residential user of age sixty-five years or older; provided, however, that the senior citizen rate shall only be available if such residential user of age sixty- five years or older (i) lives alone, (ii) lives with a spouse, or (iii) lives with one other live-in occupant in the same residential unit. If such residential unit also has other family members of the senior citizen or more than one live-in occupant, such residential unit shall not be eligible for the senior citizen rate under this section and the non-senior citizen rate shall apply. Any residential unit desiring to apply for the senior citizen rate shall apply for such at the City of Kenton Water Office.
