§ 92.08 OCCUPANT MAY ELECT TO REMOVE REFUSE; NOTICE.
   (A)   If the occupant or owner, on or before March 1 in any year, shall elect to remove refuse materials in a manner satisfactory to the village, then the materials as shall accumulate upon the premises of the occupant or owner shall not be removed by the village or its contractor and the occupant or owner shall thereupon be relieved from the obligation for the charges herein specified other than charges for use of the village waste system, but shall be obligated to have refuse materials (other than yard waste and special waste) removed by a person licensed to do so in accordance with § 92.06 and shall be subject to all penalties provided by ordinance for failure to remove refuse materials. Notice of the election, describing the premises so occupied or owned and the licensed person who will remove the refuse materials therefrom, shall be filed with the Village Manager on or before March 1 in order to relieve the person from the charge for service for the succeeding 12 months.
   (B)   Any occupant or owner who does not, on or before March 1 in any year, elect to remove all refuse materials from the premises occupied or owned by him or her, shall be conclusively presumed to have elected that the village shall remove the same in accordance with this chapter and shall pay the charge provided herein to the village at the time and in the manner herein specified.
