§ 92.06 LICENSE REQUIRED.
   (A)   (1)   No person, except the village contractor employed for that purpose, shall engage in the business of removing refuse materials, other than yard waste and special waste, as defined in this chapter from residences within the village, without first having obtained a license to do so. The license may be granted upon application to the village and upon evidence satisfactory to it that proper equipment is to be provided and will be maintained. Each applicant for a license to remove refuse materials from within the village may be required, as a condition to the granting of the license requested, that system waste be transported to and disposed at a waste disposal site specified by the village or the Agency.
      (2)   The fee as established in the annual fee ordinance.
   (B)   Any person holding a license to collect, transport or dispose of system waste shall comply with the following conditions.
      (1)   The licensee shall comply with all the laws ordinances, rules and regulations pertaining to the collection, transportation and disposal of system waste as may be enacted from time to time by any lawful authority, including the state, the Agency and the village.
      (2)   The licensee shall deliver all system waste to the transfer station designated by the Agency and the village.
      (3)   The licensee shall maintain all equipment used to collect, transport and dispose of system waste in good repair and working order and operated efficiently and effectively.
      (4)   The licensee shall collect as agent for and promptly pay to the village all rates and charges imposed by the village for use of the municipal waste system.
      (5)   The licensee shall maintain accurate books and records and make them available to the village upon demand.
