§ 92.05 REMOVAL OF REFUSE MATERIALS; RIGHT TO DISCONTINUE.
   (A)   The village may collect, remove and dispose of all refuse materials and yard waste, at intervals of time as shall be designated by the village through contract for the removal thereof, and in accordance with this chapter and additional rules and regulations as to service, rate of charge and other matters as may be in effect from time to time. No owner, occupant or lessee of any premises in the village shall be entitled to service by the village who has not complied fully with all the provisions of this chapter and with the rules and regulations in effect from time to time.
   (B)   Subject to rules and regulations in effect from time to time, refuse, other than yard waste, placed in containers conforming to § 92.03 shall be placed by the owner, occupant or lessee for collection in the rear or side yard of the premises, except for any premises served by an alley, in which case refuse placed in containers conforming to § 92.03 shall be placed for collection adjacent to the alley serving the premises. Subject to rules and regulations in effect from time to time, yard waste, placed in containers conforming to § 92.03 shall be placed for collection at curbside (no earlier than 6:00 p.m. on the day preceding the scheduled collection and no later than 7:00 a.m. on the scheduled collection day), except for any premises served by an alley, in which case yard waste, placed in containers conforming to § 92.03 shall be placed for collection adjacent to the alley serving the premises.
   (C)   The village contractor will not collect special waste unless special arrangements for the collection thereof shall be made with the village contractor by the owner or occupant of the residence, place of business or other premises from which the special waste originated.
   (D)   Where, in the judgment of the village, the removal by the village of refuse materials or yard waste entails the use of an extraordinary amount of labor or costs, or for any reason cannot be accomplished without disrupting the orderly operation of the facilities of the village or its contractor for removing refuse materials or yard waste, the village may decline to remove or contract for the removal thereof, and the village shall have the right, at its option, with or without cause, to refuse to continue to collect, remove and dispose of refuse materials or yard waste at any time it shall elect so to do.
   (E)   If the village elects not to collect, remove and dispose of refuse materials or yard waste, it shall be the duty of the owner, or his or her agent, or the occupant of the premises, to cause the materials to be removed at least once each week and more often if necessary to prevent a nuisance, and removal shall be accomplished in a manner as not to create a nuisance.
