A. Charges for the use of water within the city, as the same may from time to time be increased or decreased, and any place where water is furnished by the city, will be based upon a fee per cubic foot, as set by resolution of the city council of the city of Kamiah. There is also a minimum base rate which will be assessed to any individual property or multiple resident property, individual business or multiple business property, and vacant lots with water meter(s). Minimum base rate outside the city limits will be set by resolution of the city council of the city of Kamiah.
B. Within any building that houses more than one independent business, the deeded property owner of that building, or the contract purchaser of that building, shall pay the minimum charges set forth for each independent business within the building as specified in subsection A of this section.
C. Concerning any building which houses multiple businesses, or multiple independent tenants, the owner or contract purchaser of that building and real estate shall be charged the regular minimum fee for each independent business. In addition, any actual water used by the common meter shall then be billed to the deeded owner or contract purchaser as from time to time would be used by the building.
D. The deeded property owner or the contract purchaser of any building or real estate as set forth in subsection B and/or C of this section who is not receiving metered water services from the city shall pay the monthly base rate as set by resolution pursuant to subsection E of this section.
E. Water rates shall be set by resolution of the city council of the city of Kamiah, and shall be the rates applied to the formula for nonresidents of the city pursuant to section 13.04.120 of this chapter. The current water rates shall remain in effect until the passage of a resolution by the city council of the city of Kamiah.
F. The deeded owner or property purchaser must, as a condition of receiving continued service, sign an agreement with the city to be responsible for the bill for water services, even if the property is rented to another. Owners who shall live out of state or out of the Kamiah area may appoint an agent to act on his/her behalf for purposes of entering into said agreement with the city.
G. In the event payment for water service is made by check, and the check be returned or dishonored for any reason, the city may, as a condition of continuing water service to the property of the maker of said check, collect from said maker any bank charges made by said bank against the city for handling or processing said check or checks.
H. For all unpaid charges, the city shall be entitled to file a lien in the county auditor's office where the services are provided. Lien filing and foreclosure may be joined with actions for other unpaid utility services, pursuant to section 13.04.080 of this chapter.
I. In the event of the transfer and/or selling of real property the charges for service shall be prorated on a daily basis to include metered consumption. (Ord. 2016-5, 2016)
