The C3 Central Business District is intended as the primary business district of the community for the conduct of general business. It is the objective in this District to provide sufficient space in appropriate locations for the transaction of all types of commercial and miscellaneous service activities in beneficial relationship to one another, and thus strengthen the economic base of the community; to provide appropriate space, including sufficient ground area, permissible height and bulk of buildings including room for off-street parking facilities, to satisfy the needs of modern commercial development; and to encourage the tendency of commercial development to concentrate to the mutual advantage of both the consumer and the merchant, thus promoting public convenience, prosperity and welfare. Land in this District is intended for concentrated commercial development, which is not property associated with, nor compatible with, residential, industrial and neighborhood commercial and service establishments. Therefore, residential uses are limited and industrial or manufacturing uses (except when incidental to a retail business) are prohibited, as well as any other use which would substantially interfere with the development or continuation of the commercial structures and uses in the District.
(a) Permitted Uses.
(1) In a C3 Central Business District, land and structures may be used, and structures may be erected, altered, enlarged and maintained, for commercial uses listed hereunder, provided that:
A. All merchandise and products are sold at retail, unless otherwise stated hereunder.
B. There may be manufacturing, compounding, processing or treatment of products which is clearly incidental and essential to a retail store or business, only when the major portion of such products is to be sold at retail on the premises.
C. Such uses, operations or products are not noxious or offensive by reason of the emission of odor, dust, smoke, gas, vibration, noise or other similar causes.
(2) Single-family and two-family residential dwelling units;
(3) Multi-use residential dwelling unit;
(4) Philanthropic or religious institutions;
(5) Museums;
(6) Office appliances and supply businesses;
(7) Tire sales and repair businesses, if conducted wholly within a completely enclosed building;
(8) Wholesale merchandise establishments and incidental storage thereof, if conducted within an enclosed building;
(9) High-rise apartment buildings;
(10) Government uses or structures;
(11) Recreation areas;
(12) Professional and financial offices;
(13) Hospital, including accessory heliport;
(14) Retail stores (except where live poultry and live animals are kept on the premises;
(15) Amusement enterprises, including a billiard or pool hall, bowling alley, boxing arena, dance hall, games of skill and chance, theater or cinema (other than a drive-in theater), festival grounds, incorporating outdoor fairs, concerts;
(16) Auditoriums;
(17) Gymnasiums;
(18) Automobile sales and supply businesses, with incidental service, provided that any sales area is located and developed as required in Section 1260.115;
(19) College or university of higher learning, business colleges, and trade or proprietary schools;
(20) Catering establishments;
(21) Cleaning establishments;
(22) Clubs, social and civic;
(23) Custom dressmaking, millinery and tailoring;
(24) Day nurseries;
(25) Department and discount stores;
(26) General gardening and growing of trees and nursery stock including roadside displays and commercial signs;
(27) Frozen food storage, excluding wholesale storage;
(28) Funeral homes or mortuaries;
(29) Furniture and furnishings, sale of;
(30) General photography and reprographic arts;
(31) Hotels or motels;
(32) Interior decorating businesses;
(33) Community parking lots and garages;
(34) Libraries;
(35) Medical or dental clinics, laboratories, or medical supply houses;
(36) Opticians’ shops;
(37) Plumbing, heating, or electrical businesses not involving sheet metal;
(38) Painters’ shops;
(39) Restaurants and bars (with no upper footage limits;
(40) Sign painting;
(41) Studios: broadcasting, music, dance, art, and the like;
(42) Upholstery and minor repair of furniture and home or office furnishings; and
A. Bed and breakfast;
B. Educational or counseling institution;
C. Brewery and/or alcohol manufacturing or refining establishment held in conjunction with an on-site restaurant and/or bar.
(b) Other Provisions. Provisions regarding height, yard setbacks, lot area, and general rules are included in Appendix A - Schedule of Heights and Area Regulations.
