808.01 DEFINITIONS.
   As used in this chapter:
   (a)   "Public dance" and "public ball" mean and include any dance or ball conducted in connection with instruction in dancing for hire, and any dance or ball to which admission may be had by the payment of a fee or by the purchase, possession or presentation of a ticket or token, or in connection with which a charge is made for caring for clothing or other property, and any dance or ball to which the public generally may gain admission with or without the payment of a fee.
   (b)   "Dance hall" and "ballroom" mean and include any room, place or space in which a public dance or public ball is held and any room, hall or academy in which classes in dancing are held and instruction in dancing is given for hire.

808.02 PERMIT REQUIRED FOR PUBLIC DANCES AND BALLS.
   No person shall hold a public dance or public ball in the City without first obtaining a permit therefor from the City Manager; however, a permit shall not be required for dances held and conducted by regularly established dancing instructors in connection with such instruction.
   The fee shall be established by ordinance of City Council and amended from time to time.

808.03 LICENSING OF DANCE HALLS AND BALLROOMS; FEES; TERM.
   (a)   No person shall hold or conduct any public dance or public ball, or hold or conduct classes in dancing, or give instructions in dancing for hire, in any dance hall or ballroom in the City, unless such dance hall or ballroom has been duly licensed for such purpose.    (b)   An application for such a license shall be made by the proprietor of such dance hall or ballroom to the City Manager, who is hereby authorized to issue the same. (Ord. 4670. Passed 7-13-94.)
   (c)   The fee payable for each annual license granted shall be established by ordinance of City Council and amended from time to time.
   (d)   Each license granted hereunder shall expire on June 1 of each year.
   (e)   The fee payable for each license granted hereunder shall be for the whole or any portion of a calendar year, and all moneys received by way of license fees hereunder shall be paid into the General Fund of the City.
   (f)   Every licensed public dance hall or ballroom shall post its license in a conspicuous place within such dance hall or ballroom.

808.04 INVESTIGATION OF LICENSE APPLICANTS.
   It shall be the duty of the City Manager to cause an investigation to be made of all applicants for public dance hall or ballroom licenses to determine whether or not the dance hall or ballroom sought to be licensed complies with the rules, regulations, ordinances and laws applicable thereto. In making such an investigation, the City Manager shall, when desired, have the assistance of any City department.

808.05 COMPLIANCE WITH APPLICABLE LAWS.
   No license for a public dance hall or ballroom shall be issued until it is ascertained that the location for which it is issued complies with all applicable laws, ordinances, rules and regulations applicable thereto, is a safe and proper place for the purpose for which it is to be used, is properly ventilated and is supplied with sufficient toilet facilities.

808.06 DISORDERLY OR IMMORAL CONDUCT.
   The license of any public dance hall or ballroom may be forfeited or revoked by the City Manager for disorderly or immoral conduct on the premises, or upon proof that the dance hall or ballroom was frequented by disorderly or immoral persons, or for a violation of any of the rules, regulations, ordinances and laws governing or applying to public dances, dance halls or ballrooms. If, at any time, the license of a public dance hall or ballroom is forfeited or revoked, at least three months shall elapse before another license or permit is granted for dancing on the same premises.

808.07 SANITATION AND SAFETY.
   All public dance halls or ballrooms shall be kept at all times in a clean, healthful and sanitary condition, and all stairways and other passages and all rooms connected with the public dance hall or ballroom shall be kept open and well lighted.
