(a) No person, knowing that he or she is not licensed or privileged to do so, shall enter or remain in any place as to which notice against trespass is given by:
(1) Actual communication to the actor;
(2) Posting in a manner prescribed by law or reasonably likely to come to the attention of intruders; or
(3) Fencing or other enclosure manifestly designed to exclude intruders.
(b) Defiant trespass is a summary offense, and therefore a violation of this section, only if the actor does not defy an order to leave personally communicated to him or her by the owner of the premises or other authorized person. Otherwise, the actor shall be prosecuted under State law.
(c) It is a defense to prosecution under this section that:
(1) The premises were at the time open to members of the public and the actor complied with all lawful conditions imposed on access to or remaining in the premises; or
(2) The actor reasonably believed that the owner of the premises, or other person empowered to license access thereto, would have licensed him or her to enter or remain.
