As used in this chapter:
(a) "Act" means the Municipal Pension Plan Funding Standard and Recovery Act (Act 205 of 1984 (P.L. 1005), 53 P.S. 895.101 et seq., as amended).
(b) "Actuary" means the person, partnership, association or corporation which, at any given time, is serving as actuary, provided that such actuary must be an "approved actuary" as defined in the Act.
(c) "Code" means the Third Class City Code.
(d) "Compensation" means the total pay which appears on a member's Form W-2 for Federal income tax purposes.
(e) "Council" means the Council of the City of Johnstown.
(f) "Disability" means a condition of total and permanent physical or mental impairment, due to which a member is certified by a sworn statement of three practicing physicians, designated by the Board, that the employee is in a permanent condition of health which would permanently disable him or her from performing the duties of his or her position or office.
(g) "Effective date" means the date upon which this chapter (Ordinance 4440, passed October 28, 1987) becomes effective, that is, January 1, 1988.
(h) "Employee" means any person who is an employee of the City and who is not a part-time personal employee, excluding those employees of the Police and Fire Departments and employees of the Bureau of Sewage, including those persons who are members of the Bureau of Sewage who have been transferred to another department covered by the Officers' and Employees' Pension Plan and for whatever reason are disadvantaged by having to change pension plans, including, however, as an employee hereunder, those persons who have been transferred to the Bureau of Sewage from a department covered by this chapter and again, for whatever reason, are disadvantaged by having to change pension plans.
(i) "Employer" means the City of Johnstown.
(j) "Final monthly average salary" means, for employees hired before January 1, 2017, the monthly equivalent of a member's average annual salary that the member received during the final 24-month period prior to the employee's retirement, or during any 60-month period of the member's employment with the employer, whichever is greater. For employees hired on or after January 1, 2017, "final monthly average salary" shall be calculated based on the final 36-month period prior to the employee's retirement.
(k) "Member" means an employee who has met the eligibility requirements of Section 287.03 and who has not, for any reason, ceased his or her participation in the Plan.
(l) "Pension Fund" means the assets of the Plan administered under this chapter and under the rules and regulations of the Board of Trustees, as set forth in Section 287.02, which assets include all money, property, investments, policies and contracts that are a part of the Plan.
(m) "Plan" means the pension plan set forth herein and designated as the City of Johnstown New Officers' and Employees' Pension Plan.
(n) "Plan year" means the 12-month period beginning on January 1 and ending on the subsequent December 31 of each year.
(o) "Social security benefit" means the participant's primary old-age insurance benefit, calculated under the provisions of the Federal Social Security Act in effect on the date of his or her termination, but based only upon compensation earned in employment covered by the Plan provided for herein.
(p) "Year of credited service" means a 12-month period of employment during which a member is employed with the employer and paid out of the City Treasury. Service shall be calculated to completed years from an employee's date of hire through his or her date of retirement or severance.
