CHAPTER 155
Enterprise Zone; Community Reinvestment Areas
155.01   Enterprise Zone established.
155.02   Community Reinvestment Area Number One.
155.03   Community Reinvestment Area Number Two.
155.04   Community Reinvestment Area Number Three.
 
155.01 ENTERPRISE ZONE ESTABLISHED.
   Council hereby authorizes the County to include the Village of Johnstown, Ohio, as it currently exists and as it may be expanded from time to time by annexation, in the Enterprise Zone.

155.02 COMMUNITY REINVESTMENT AREA NUMBER ONE.
   (a)   Council hereby establishes a Community Reinvestment Area hereafter denoted as “Community Reinvestment Area No. 1", a map of said area being set forth in Exhibit A.
   (b)   The boundaries of Community Reinvestment Area No. 1 shall be those as set forth in Exhibit A, and as described therein, the same being incorporated by reference as fully as if entirely rewritten.
   (c)   (1)   Within Community Reinvestment Area No. 1 there shall be an exemption for real property improvement taxation on the improvements, only as set forth in Ohio R.C. 3735.67(B) and (C) for the following periods:
         A.   Ten years for the remodeling of every industrial property upon which the remodeling cost exceeds fifty thousand dollars ($50,000);
         B.   Ten years for the construction or expansion of any industrial structure upon which the cost exceeds fifty thousand dollars ($50,000).
      (2)   For purposes of this section, the exemption granted in subsection (c)(1)A. hereof shall be as set forth in Ohio R.C. 3735.67(B), and the exemption provided in subsection (c)(1)B. hereof shall be as set forth in Ohio R.C. 3735.67(C).
      (3)   Further, provided that multi-family, retail and commercial uses as the same are defined in Part 11 of the Codified Ordinances of the Village of Johnstown shall not be considered industrial for purposes of determining eligibility for the exemptions provided herein.
   (d)   In order to implement and administer the provisions herein, the Manager is hereby designated the Housing Officer. Said Officer shall have the power and authority as designated by Ohio R.C. 3735.67(B) and (C).
   (e)   A certified copy of this section shall be forwarded to the County Auditor by the Clerk for information and reference.
   (f)   Council reserves the right to review and re-evaluate Community Reinvestment Area No. 1 in order to determine the continued necessity for the Community Reinvestment Area No. 1.
   (g)   Council specifically finds and concludes that the Community Reinvestment Area as described in the attachment hereto is an area in which housing facilities or structures of historical significance are located and the housing construction and repair of existing facilities is to be discouraged.
   (h)   (1)   There is hereby established the Community Reinvestment Area Housing Council consisting of two members appointed by the Mayor, two members appointed by Council, one member appointed by the Planning and Zoning Commission. The majority of the foregoing group shall appoint two additional members who shall be residents of the area.
      (2)   Appointments and the filling of vacancies shall be in conformity with Ohio R.C. 3735.69.
   (i)   The Housing Council shall make an annual inspection of all properties within the Community Reinvestment Area and report its findings to the Village Council. Based upon said report, the Housing Council shall determine to continue any exemptions quoted, or it may elect to revoke same pursuant to Ohio R.C. 3735.68.
   (j)   The Housing Council shall hear all appeals with respect to the application and determination of eligibility for the exemption provided herein.

155.03 COMMUNITY REINVESTMENT AREA NUMBER TWO.
   (a)   Council hereby establishes a Community Reinvestment Area hereafter denoted as “Community Reinvestment Area No. 2", a map of said area being set forth in Exhibit B.
   (b)   The boundaries of Community Reinvestment Area No. 2 shall be those as set forth in Exhibit B and as described therein, the same being incorporated by reference as fully as if entirely rewritten.
   (c)    (1)   Within Community Reinvestment Area No. 2 there shall be an exemption for real property improvement taxation on the improvements, only as set forth in Ohio R.C. 3735.67(B) and (C) for the following periods:
         A.   Seven years for the remodeling of every retail commercial property upon which the remodeling cost exceeds two million dollars ($2,000,000);
         B.   Seven years for the construction or expansion of any retail commercial structure upon which the cost exceeds two million dollars ($2,000,000).
      (2)   For purposes of this section, the exemption granted in subsection (c)(1)A. hereof shall be set forth in Ohio R.C. 3735.67(B), and the exemption provided in subsection (c)(1)B. shall be set forth in Ohio R.C. 3735.67(C).
      (3)   Further, provided that industrial uses, multi-family uses as the same are defined in Part 11 of the Codified Ordinances of the Village of Johnstown nor uses expanding facilities for which a previous exemption would have been obtained, or a facility which could have obtained an exemption, but did not, shall not be considered industrial for purposes of determining eligibility for the exemptions provided herein.
   (d)   In order to implement and administer the provisions herein, the previously established Housing Council and Housing Officer as set forth in Section 155.02 shall have the power and authority as designated by Ohio R.C. 3735.67(B) and (C).
   (e)   A certified copy of this section shall be forwarded to the County Auditor by the Clerk for information and reference.
   (f)   Council reserves the right to review and reevaluate Community Reinvestment Area No. 2 in order to determine the continued necessity for Community Reinvestment Area No. 2.
   (g)   Council specifically finds and concludes that the Community Reinvestment Area as described in the attachment hereto is an area in which housing facilities or structures of historical significance are located and the housing construction and repair of existing facilities is to be discouraged.
   (h)   The Housing Council shall make an annual inspection of all properties within the Community Reinvestment Area and report its findings to Council. Based upon said report, the Housing Council shall determine to continue any exemptions quoted, or it may elect to revoke same pursuant to Ohio R.C. 3735.68.
   (i)   The Housing Council shall hear all appeals with respect to the application and determination of eligibility for the exemption provided herein.

155.04 COMMUNITY REINVESTMENT AREA NUMBER THREE.
   (a)   Council hereby establishes a Community Reinvestment Area hereinafter denoted as “Community Reinvestment Area No. 3".
   (b)   The boundaries of Community Reinvestment Area No. 3 shall be Jersey Street on the south, Maple Street on the north, Kasson Street on the east and Wiliams Street on the west. Community Reinvestment Area No. 3 shall consist of all property within these boundaries which is, or which subsequently is, zoned as GCC-1.
   (c)   (1)   Within Community Reinvestment Area No. 3 there shall be an exemption for real property improvement taxation on the improvements only as set forth in Ohio R.C. 3735.67(B) and (C) for the following periods:
         A.   Five years for the remodeling of every retail or commercial property upon which the remodeling cost exceeds five thousand dollars ($5,000).
         B.   Ten years for the construction or expansion of every retail or commercial property upon which the construction or expansion costs exceeds twenty-five thousand dollars ($25,000).
      (2)   For purposes of this section, the exemption granted in subsection (c)(1)A. hereof shall be as set forth in Ohio R.C. 3735.67(B), and the exemption provided in subsection (c)(1)B. hereof shall be as set forth in Ohio R.C. 3735.67(C).
      (3)   Further, provided that residential, multi-family or industrial uses as the same are defined in Part 11 of the Codified Ordinances of the Village of Johnstown, shall not be considered retail or commercial for purposes of determining eligibility for the exemptions provided herein.
   (d)   In order to implement and administer the provisions herein, the Manager is hereby designated the Housing Officer. Said Officer shall have the power and authority as designated by Ohio R.C. 3735.67(B) and (C).

   (j)   The Housing Council shall hear all appeals with respect to the application and determination of eligibility for the exemption provided herein.
