5-2-12: CORRECTION OF VIOLATIONS:
   A.   The completed inspection report form shall specify a reasonable period of time for the correction of the violations found, and correction of the violations shall be accomplished within the period specified, in accordance with the following provisions:
      1.   Any situation in which the regulatory authority declares an imminent health hazard, the food establishment shall immediately cease food service operations. Operations shall not be resumed until authorized by the regulatory authority.
      2.   All priority and priority foundation items shall be corrected at the time of inspection. If no immediate correction is possible because of the complexity of the corrective action needed, the regulatory authority may agree to or specify a longer time frame, not to exceed seventy two (72) hours for priority items and ten (10) calendar days for priority foundation items or HACCP plan deviations.
         a.   After observing correction of a violation of a priority or priority foundation item or HACCP plan deviation at the time of the inspection, the violation and information about the corrective action shall be entered on the inspection report.
         b.   After receiving notification that a violation of a priority or priority foundation item or HACCP plan deviation has been corrected, or at the end of the specified period of time, the regulatory authority shall verify correction of the violation and document the information on an inspection report. If a follow-up inspection is necessary to verify correction of a violation, a reinspection fee, in the amount set by the Jo Daviess County Board of Health and approved by resolution of the Jo Daviess County Board, shall be assessed.
      3.   All core items shall be corrected as soon as possible, but no later than the next routine inspection. The regulatory authority may approve a compliance schedule that extends beyond the next routine inspection if a written schedule of compliance is submitted and no health hazard exists or will result from allowing an extended schedule for compliance.
      4.   If a food establishment has a repeat foodborne illness risk factor violation noted on three (3) consecutive inspections, a hearing notice will be served in accordance with section 5-2-15 of this chapter.
      5.   If a food establishment has the same good retail practices violation that can be marked in conjunction with a foodborne illness risk factor or may contribute to a foodborne illness risk factor noted on three (3) consecutive inspections, a hearing notice will be served in accordance with section 5-2-15 of this chapter.
      6.   If a food establishment has more than six (6) repeat violations noted per inspection for three (3) consecutive inspections, a hearing notice will be served in accordance with section 5-2-15 of this chapter.
   B.   Failure to comply with any time limits for correction may result in license suspension.
   C.   Whenever a food establishment is required under the provisions of this section to cease operation, it shall not resume operations until it is shown on reinspection that conditions for the order to cease operation no longer exist.
   D.   If a food establishment has continued non-conformance with this chapter or has numerous and valid complaint investigations and the regulatory authority deems necessary, the risk classification of the food establishment can be changed at any time. (Ord. 2018-10, 10-9-2018, eff. 12-1-2018)
