Any fund which, in its entirety, is provided by tax levy or service charge shall not be transferred to any other fund. It is further provided that if and in the event any ordinance or directive from the executive branch violates Section 5.05, that said transferred funds be returned immediately to the taxpayer or pro rata to the taxpayers who have contributed to said fund. It is further provided that if the members of said class cannot be readily ascertained, all those claiming to be members of said class may file a petition within thirty days in the Ironton Municipal Court for determination of their rights, if any, to participate in the disbursement of said funds.
