§ 94.15 NOTICE TO OWNER TO CUT NOXIOUS WEEDS; REMOVE LITTER; SERVICE.
   (A)   Upon a finding by the City Manager that noxious weeds are growing on premises, the City Manager shall cause a written notice to be served upon the owner, lessee, agent, or tenant having charge of such premises, notifying him or her that noxious weeds are growing on such premises and that they must be cut and destroyed within five days after the service of such notice.
   (B)   Upon a finding by the City Manager that litter has been placed on premises, and has not been removed, and constitutes a detriment to public health, the City Manager shall cause a written notice to be served upon the owner and, if different, upon the lessee, agent, or tenant having charge of the littered premises, notifying him that litter is on the premises, and that it must be collected and removed within 15 days after the service of the notice.
   (C)   If the person served with the notice, as provided in division (A) of this section, has been found in violation of this § 94.15 at any time during the five years prior to the date of the current notice, he or she shall be deemed to be in immediate violation and shall not be granted an additional five/fifteen days to cause such violation to cease. He or she shall be immediately subject to the penalty provided in § 94.99, and a separate offense shall be deemed committed upon each and every day during or on which the violation occurs or continues beyond the original date of notice, provided, however, that no additional notice of violation is required to be given for the subsequent days.
   (D)   If the owner or other person having charge of the premises is a nonresident of the village whose address is known, the notice shall be sent to his address by certified mail. If the address of the owner or other person having charge of the premises is unknown it is sufficient to publish the notice once in a newspaper of general circulation in the county.
   (E)   In addition to the power and authority granted in division (B), the City Manager is authorized, upon his or her own motion, with or without written notice, to cause the cutting and destruction of noxious weeds in accordance with the procedures set forth in R.C. § 731.51.
