(a) Membership.
The Civil Service Commission shall consist of three (3) electors of the Municipality not holding other elective or appointive office in the Municipality, to be appointed by the Mayor, with the approval of a majority of the members elected to the Council. Each shall serve for a term of six (6) years, except that one of the three (3) electors first appointed shall be designated by the Mayor to serve for a term of two (2) years and one for a term of four (4) years, all commencing January 1, 1960. A vacancy occurring during the term of any member of the Commission shall be filled for the unexpired term by appointment by the Mayor with the approval of a majority of the members elected to the Council. At its first meeting in January, 1960, and every two (2) years thereafter, the Commission shall elect one of its members as Chairperson to serve for a period of two (2) years. The Commission may appoint a Secretary who need not be a member of the Commission and who may hold other municipal office or appointment.
(b) Classified Service.
The classified service shall include all positions and employment in the municipal service, except:
(1) Any member of a board or commission.
(2) Any head of a department including the heads of the Police and Fire Departments.
(3) Any secretary to the Mayor.
(4) Any clerical employee of or assistant to the head of any department.
(5) Any clerical employee in the Police and Fire Departments.
(6) Any officer elected by the people.
(7) Any officer or employee appointed by Council.
(8) Any fireman and policeman serving on a part-time or volunteer basis.
(9) Any person duly licensed to practice a profession by the State of Ohio and employed in such capacity by the City.
(10) Any unskilled or temporary labor, as determined by the Civil Service Commission. (Approved by voters November 4, 1975. )
(c) Duties of Commission.
The Commission shall provide by rule for ascertainment of merit and fitness as the basis for appointment and promotion in the classified service of the Municipality as required by the Constitution of the State of Ohio, and for appeals from the action of the Mayor in any case of transfer, reduction or removal, and the action of the Commission on any such appeal shall be final. The Commission shall keep a record of its proceedings and examinations, which shall be open to public inspection, and, in all matters not in conflict with this Charter, shall conduct its affairs in accordance with the provisions of general law.
