773.06 PROVIDER QUALIFICATIONS.
   (a)    The applicant and/or provider shall be at least eighteen (18) years of age.
   (b)    The applicant must present satisfactory evidence of personal residence in the dwelling to be used as child day-care home.
   (c)    The provider shall be examined by a licensed physician or certified nurse practitioner not more than six months prior to submission of the permit application, and shall provide a statement, signed by a licensed physician or certified nurse practitioner that states that the provider is free from any communicable diseases or other condition that could affect his/her ability to perform child care duties and which do not pose a serious threat to the well-being of any child in his/her care.
   (d)   Upon issuance of child day-care home permit, the provider shall submit a new medical statement at least once every two (2) years. The medical statement shall be confidential and shall not be a public record, unless specifically required by law.
   (e)   The provider or any resident of the home shall not:
      (1)   Be under the influence of alcohol or other drugs while child care is being provided.
      (2)   Have been convicted of or pleaded guilty to crimes or offenses listed in Section 5104.012 of the Ohio Revised Code.
      (3)   Have been convicted of or pleaded guilty to crimes listed in division (A)(1) of Section 5104.09 of the Ohio Revised Code.
   (f)   The provider and every individual eighteen (18) years of age or older residing in the home shall sign a "Child Care Conviction Statement" attesting that he has not been convicted of, or pleaded guilty to, any offense listed in division (A)(1) of the Section of 5104.09 of the Ohio Revised Code and that no child has been removed from his or her home pursuant to Section 2151.353 of the Ohio Revised Code.
   (g)    The provider shall sign the "Child Care Conviction Statement" attesting that no person who resides at the home and who is under the age of eighteen (18) has been determined by the court to be delinquent child for committing a violation of any provision listed in division (A)(1) of Section 5104.09 of the Ohio Revised Code.
   (h)    The provider shall have received training in first aid and cardiopulmonary resuscitation (CPR) appropriate to the age range of the children in provider's care. The training shall be provided by an American Red Cross and/or American Heart Association certified instructor. The provider shall provide evidence of training upon initial application and upon each renewal application.
   (i)   The provider shall have received training in the prevention, recognition and management of communicable diseases from the American Red Cross or other City approved certified agency or instructor. The provider shall provide evidence of training upon initial application and upon each renewal application.
   (j)   The provider shall disclose within the permit application and, in writing, to the parent, guardian, custodian or other person responsible for the care of the child the following information if applicable:
      (1)   That a child died while in the care of the provider or as a result of injuries suffered while under the care of the provider; or
      (2)   That a child suffered injuries while under the care of the provider that led to the child being hospitalized for more than twenty-four (24) hours.
   (k)   The provider shall provide proof of insurance as required by Section 773.13 below.
   (l)   The provider shall sign and agree to a criminal background check which shall be performed by the City's Police Department.
