953.01 FEES FOR GRAVES AND NICHES.

   The price of a grave in the Municipal Cemetery shall be six hundred seventy-five dollars ($675.00), and for any other grave space not specifically identified herein. The price for a niche in the Municipal Cemetery shall be six hundred dollars ($600.00). Graves and niches in the Municipal Cemetery shall be available only to residents of the City who have maintained residence in the City for at least five consecutive years. However, former residents of the City may purchase grave or niche space at the same price per grave or niche, provided the former resident is able to prove past City residency of at least five consecutive years. The burden to prove the residence requirement herein shall be on the person seeking to purchase a grave or niche site. No burial shall be permitted in the Municipal Cemetery until the grave or niche space purchase price has been paid to the Finance Director. All sales of grave or niche space, irrespective of when made, are subject to the condition that a resale, transfer or assignment is expressly prohibited, unless and until the City, through its Finance Director, is given the first option to repurchase such grave or niche space, at a price which is ninety percent (90%) of the actual price paid for the grave space with the difference being attributable to administrative expense. An administrative fee of one hundred fifty dollars ($150.00) shall be paid to the City upon any resale, transfer or assignment to any person eligible to purchase a grave or niche space herein. This condition shall be expressly stated in all receipts or documents of sale made from and after the date hereof.
