ADMINISTRATION AND ENFORCEMENT
§ 152.110 ENFORCEMENT AUTHORITY; VIOLATIONS.
   (A)   The Director of Engineering and/or Zoning Administrator is responsible for the administration and enforcement of this chapter.
   (B)   Any violation of the provisions of this chapter or failure to comply with any of its requirements (including violations of conditions and safeguards established in connection with grants of variances or conditional uses) shall constitute a misdemeanor and shall be punishable as defined by law. Violations of this chapter can occur regardless of whether or not a permit is required for a regulated activity pursuant to § 152.111 of this chapter.

§ 152.111 PERMITS REQUIRED.
   (A)   A permit is required for the construction of buildings or building additions (including related activities such as construction of decks and signs), the installation or alteration of sewage treatment systems, and those grading and filling activities not exempted by § 152.039 of this chapter. Application for a permit shall be made to the Zoning Administrator on the forms provided. The application shall include the necessary information so that the Zoning Administrator can determine the site’s suitability for the intended use and so that a compliant sewage treatment system will be provided.
   (B)   A permit authorizing an addition to an existing structure shall stipulate that an identified non-conforming sewage treatment system, as defined by § 152.042 of this chapter, shall be reconstructed or replaced in accordance with the provisions of this chapter. Construction installation is restricted to only state certified installers, as defined by the State Pollution Control Agency.

§ 152.112 CERTIFICATE OF ZONING COMPLIANCE.
   (A)   The Zoning Administrator shall issue a certificate of occupancy or zoning compliance for each activity requiring a permit as specified in § 152.111 of this chapter.
   (B)   This certificate will specify that the use of land conforms to the requirements of this chapter.
   (C)   Any use, arrangement or construction at variance with that authorized by permit shall be deemed a violation of this chapter and shall be punishable as provided in § 152.110 of this chapter.
