2-10-3: STATE OF LOCAL DISASTER EMERGENCY:
   A.   A state of local disaster emergency may be declared by the mayor, having a local disaster emergency plan, upon a finding by such officer that a disaster has occurred or the threat thereof is imminent within the city.
   B.   No state of local disaster emergency shall be continued for a period in excess of ten (10) days or renewed except with the consent of the Helena city commission.
   C.   Any order or proclamation declaring, continuing or terminating a state of local disaster emergency shall be given prompt and general publicity and shall be filed promptly with the city clerk.
   D.   In the absence of the mayor, or if the mayor is incapacitated, the city commission, by majority action of the remaining members thereof, may declare a state of local disaster emergency.
   E.   The declaration of a state of local disaster emergency shall activate the response and recovery aspects of any and all local disaster emergency plans which are applicable to the city, and shall initiate the rendering of aid and assistance thereunder. (Ord. 2910, 6-4-2001)
