2-6-3: EXISTING BOARDS:
There shall be:
   A.   A housing authority, constituted and possessing the powers granted in state law.
   B.   A board of adjustment constituted and possessing the powers and duties delegated to it in this code and, so far as not inconsistent therewith, the powers and duties prescribed by law. (Ord. 2914, 7-23-2001)
   C.   A zoning commission constituted and possessing the powers and duties delegated to it in this code and, so far as not inconsistent therewith, the powers and duties prescribed by law.
      1.   The zoning commission shall be appointed by the mayor with the concurrence of the city commission. There shall be five (5) members and one alternate, all of whom must be residents of the city of Helena.
      2.   Each member will serve a term of three (3) years with the terms being staggered. Initially, one member shall be appointed for a one year term, one member for a two (2) year term, and the third member for a three (3) year term. Thereafter, each appointment to the zoning commission shall be for a three (3) year term. The alternate member shall be appointed for a three (3) year term.
      3.   The alternate will serve only in the event that a regular member is unable to attend a meeting.
      4.   The zoning commission shall select one of the members to chair the meetings and it may adopt operating rules.
      5.   Three (3) members constitute a quorum. (Ord. 3066, 10-30-2006)
   D.   A board of appeals constituted and possessing the powers and duties provided in the international building code, as amended from time to time. In addition, the board of appeals shall possess the duties of an appeals board for the electrical, mechanical, plumbing, and fire codes. (Ord. 3195, 6-23-2014)
      1.   Said board shall determine the suitability of alternate materials and methods of construction and provide for reasonable interpretations of the international building, electrical, mechanical, and plumbing codes.
      2.   The board of appeals is appointed by the mayor with the concurrence of the city commission. There are five (5) members of said board, along with two (2) alternates. The five (5) members of the board must consist of the following:
         a.   The chief building official who is a nonvoting member;
         b.   A member of the fire department;
         c.   A consumer/citizen of the city;
         d.   An architect or engineer practicing in the city; and
         e.   A contractor doing business in the city.
      3.   In addition to the five (5) regular members of said board, the mayor, with the concurrence of the city commission, shall appoint two (2) alternate members.
      4.   Each member of this board shall serve for a term of five (5) years from the date of appointment. The terms of the members of this board are staggered. Two (2) members will be appointed for initial terms of three (3) years, and three (3) members will be appointed for initial terms of two (2) years. Thereafter, each board member shall serve a term of five (5) years.
   E.   The Helena/Lewis And Clark County consolidated planning board, a consolidation of the planning boards of the city of Helena and Lewis And Clark County. This consolidated planning board is constituted and organized by interlocal agreement between the city of Helena and Lewis And Clark County. It possesses the powers granted by the interlocal agreement, state law, and this code and may exercise those powers within its jurisdictional area.
   F.   A city planning board that possesses the powers granted by state law and this code. It may exercise those powers over the jurisdictional area of the city of Helena located within Jefferson County. The city planning board shall have no less than seven (7) members with qualifications required by state law, and the board may include additional members representing Jefferson County as is agreed upon between the city of Helena and Jefferson County. Any member of the Helena/Lewis And Clark County consolidated planning board who is otherwise qualified by law may serve as a member of the city planning board. This board may be combined by interlocal agreement with Jefferson County into either a joint planning board with the Jefferson County planning board or a consolidated city-county planning board. If combined, the jurisdictional area of the combined planning board will be defined by the interlocal agreement.
   G.   An affordable housing trust fund advisory board that will review and make funding allocation recommendations to the Helena City Commission for each project applying for support from the Affordable Housing Trust Fund that was created by Resolution No. 20630 on November 9, 2020.
      1.   The affordable housing trust fund advisory board is appointed by the mayor with the concurrence of the city commission. There are seven (7) members of the affordable housing trust fund advisory board. The seven (7) members of the affordable housing trust fund advisory board consist of the following:
         a.   One (1) member with direct experience in housing insecurity;
         b.   One (1) resident of the City of Helena at large;
         c.   One (1) member of the nonprofit housing sector;
         d.   One (1) member of the real estate sector;
         e.   One (1) member with a background in engineering or architecture; and
         f.   Two (2) members from the field of banking or finance.
      2.   Each member of this board will serve for a term of three (3) years from the date of appointment. The terms of the members of this board are staggered. Four (4) members will be appointed for initial terms of two (2) years, and three (3) members will be appointed for initial terms of one (1) year.
