2-5-8: FIRE PROTECTION CONTRACT:
If the city commission elects to provide the fire protection in response to the aforesaid application, the following rules govern such contract for said fire protection:
   A.   The contract must be executed by the applicant pursuant to proper authority by its governing body, or in the case of individuals or corporations, by an authorized person or persons.
   B.   After proper execution by the applicant and approval by the city attorney, the contract will be submitted to the commission, and upon proper approval by the commission will be executed by the proper city officials and a copy thereof delivered to the applicant. The contract will be in force and effect from and after execution and delivery by the city.
   C.   Cost of protection outside of the city is determined according to the assessed valuation of the property to be protected; provided, however, where the property is not subject to taxation and there is no valuation, the city commission may negotiate a reasonable sum with the applicant for the protection.
   D.   The fire chief or the officer in charge may retain in the city such equipment and personnel as, in the fire chief's or officer's opinion, are necessary for the proper and adequate protection of the city. The fire chief or officer in charge may dispatch for the protection of the applicant only such personnel and equipment in response to fire alarms or calls by authorized persons as can for the time being be safely spared from the city. In case of emergency within the city while the equipment and personnel of the fire department are engaged in fighting a fire for the applicant, the fire chief, or other officer in charge of the fire department may recall to the city from the service of said applicant such equipment and personnel as is considered necessary to meet said emergency. The determination of the chief or active head of the fire department as to which equipment shall be furnished or withdrawn as provided herein is final and conclusive.
   E.   No charge may be imposed for the use of fire equipment or personnel in the case of communities maintaining fire departments which have reciprocal agreements for such service with the city. (Ord. 2910, 6-4-2001)
