A. The city commission has the sole authority to grant height variances for towers. The city commission shall follow the standards and criteria of this chapter when considering a variance for the height of a tower.
B. The city commission may grant a variance from the requirements listed above if the requested variance is related to an application for a conditional use. The city commission shall follow the standards and criteria listed below when considering a variance. Additional review by the board of adjustment is not required on variances that are related to an application for a conditional use. The city commission hereby reserves this authority unto itself pursuant to section 76-2-321(2), Montana Code Annotated, and further reserves unto itself any and all other authority not hereinabove granted to the board of adjustment.
