A. Any person desiring to cut through or tear open the surface of any street, alley or other roadway within the city shall first file a written application with the building division of the community development department for an opening permit. Said application shall state the object sought, the purpose for which said street is to be cut through or broken open, the proposed area of such opening, the time needed to accomplish the proposed work, and the exact location thereof. The building division shall notify the public works department of the application.
B. The building division may, after approval from the public works department, grant or refuse to grant such application for an opening permit. The refusal of the building division to grant an opening permit is subject to review by the city manager. If the opening permit is granted, the applicant shall accomplish the proposed work within the time allowed by the permit, and shall backfill any such excavation with proper compaction.
