6-3-5: SEPTIC WASTE DISCHARGE REGULATED:
   A.   Except as herein provided, no person shall cause any septic waste to be disposed of in any part of the wastewater system owned and operated by the city.
   B.   Persons wishing to dispose of septic waste in the city wastewater system shall dump said waste into designated waste receptacle facilities at the city wastewater treatment plant or as assigned by the water/wastewater treatment division. Said dumping shall be done under the supervision of the city director of public works or the director's designee. If septic waste is determined to be harmful to the wastewater treatment processes, the city reserves the right to discontinue the dumping of said waste.
   C.   The Helena city commission may, from time to time, establish fees for the discharge of septic waste pursuant hereto. Said fees shall be adopted by resolution after the appropriate public hearings have been held. The fees are to be billed to the septic waste hauler monthly by the water/wastewater treatment division. Payment is due thirty (30) days from the date mailed. If any sum or amount of the bill to a hauler is delinquent after thirty (30) days, the hauler shall be given written notice of the delinquency and advised that unless the delinquent bill is paid in full within fifteen (15) days of the date of notification, the hauler will lose the privilege of disposing of septic waste at the wastewater treatment facility. Notice of delinquency will be given by depositing the notice in the U.S. mail, addressed to hauler's last known address with postage prepaid, or by personally delivering the notice to the hauler or hauler's agent. The privilege to dispose of septic waste may not be reestablished until the hauler pays any outstanding amount owed in full and pays the costs for collection of those fees.
   D.   Any person violating this section shall be subject to the criminal and civil provisions of chapter 4 of this title. (Ord. 2925, 12-3-2001)
