8-4-12: MAINTENANCE:
   A.   Maintenance requirements and responsibility shall be clearly identified for all projects where best management practices are employed, including BMPs for erosion and sedimentation control and storm water management. When a storm water system is designed to service more than one lot, a maintenance agreement between all parties which benefit from the system must be established, including assurance of adequate funding. Easements across private property for maintenance access to community storm water systems shall also be required where necessary. All maintenance agreements must be approved by the administrator.
   B.   In the event that appropriate maintenance of any storm water system is not conducted, the city shall have the option of requiring the property owner or association to provide for maintenance, or take other enforcement measures as outlined in section 8-4-13 of this chapter.
