7-1-2: INSTALLATION AND MAINTENANCE OF EQUIPMENT:
The water department will, at the expense of the city, run a service pipe not larger than three-fourths inch (3/4") from the city water main to the lot line of any applicant or consumer of water, provided that the distance is not greater than seventy five feet (75'). All pipe of one inch (1") in size is to be laid by and under the direction of the city water department, and the expense thereof charged to the consumer or owner of the property served. The water consumer, or the owner of the property served, shall at all times be responsible for the condition of the lateral pipes, curb cock and box when located on his premises, and said owner, or water consumer, shall be responsible for all damages resulting from leaks or breaks to the service pipe on his property. No claim shall be made against the city on account of the breaking of any service pipe or apparatus, or for the failure in the supply of water. The city will be responsible for repair of leaks that occur upon public property. Where a break or leak occurs in a lateral service pipe, the property owner or water consumer will be required to repair the pipe at his own expense and to protect the city and the water department from any cost for such repair. If, after being notified, the owner of the property upon which a break or leak occurs or his agent does not make the necessary repairs to his lateral service pipe immediately, the water department shall cause the water to be shut off from said premises, and the same shall not be turned on until the service pipe has been properly repaired and the owner or water consumer has paid to the city the fees set out in chapter 5 of this title for the shutting off and turning on of said water. Where a break or leak occurs in a lateral service pipe, the property owner or water consumer shall be responsible for any and all damages resulting therefrom. Where there is a leak and it is doubtful whether the water is from a break in the city main or in a private service pipe or lateral line, the city shall have charge of the repairs but the costs of repairs shall be assessed to the proper private property owner or consumer in the event the leak or break is in a service pipe or lateral line.
