1. Each owner shall submit to the Township a contract between the applicant and the holding tank cleaner covering collection and disposal of the holding or retention tank's contents, which contract must be approved by the Township. In the event that the applicant fails in any regard to follow each and every term and provision of the regulations of the Department of Environmental Resources or the terms and provisions of this Part in regard to the disposal of the holding tank's contents, the ultimate responsibility for the proper collection and disposal of such contents shall be with the Township. The holding tank cleaner and the disposal site shall be approved by the Department of Environmental Resources prior to the disposal of contents of holding or retention tanks.
2. The Township will receive, review and retain pumping receipts from permitted holding tanks.
3. The Township will review and retain annual inspection reports for each permitted tank.
4. In the event connection to a sewer system is approved for discharge during off-peak periods, it shall not relieve the owner from § 18-505, subsections (1), (2), and (3), above. Each owner shall have a disposal contract in place that will provide for pumping out the tank's contents during periods of precipitation or other high water in the receiving sewer, when discharge in the sewer would aggravate the overflow condition.
