§ 133.999 PENALTY.
   (A)   Firearms.
      (1)   Except as provided in division (A)(2) below, conviction for violation of any of the provisions of §§ 133.001 through 133.005 shall be punished by a fine not to exceed $500 or by imprisonment of not more than 90 days or by both a fine and imprisonment, in the discretion of the court.

      (2)   (a)   An individual without a concealed pistol permit who has an alcohol content of .08 or more grams per 100 milliliters of blood, per 210 liters of breath, or per 67 milliliters of urine or because of the consumption of alcoholic liquor, a controlled substance, or a combination of alcoholic liquor and a controlled substance, the individual’s ability to use a firearm is visibly impaired is guilty of a misdemeanor subject to punishment of not more than 90 days imprisonment and a fine of not more than $100 for carrying or possessing a firearm, or both, and not more than $500 for using or discharging a firearm, or both.
         (b)   An individual with a concealed pistol permit shall be reported to the firearm licensing board and subject to the following penalties depending on his or her blood alcohol level:
            1.   A civil infraction with a fine of up to $100 for a person with .02 to .079 BAC (blood alcohol level) or deemed to be visibly impaired;
   
            2.   A misdemeanor punishable by up to 90 days imprisonment and a $100 fine for a person with .08 to .099 BAC;
            3.   A misdemeanor punishable by up to 90 days imprisonment and a $100 fine for a person with .10 or more BAC.
   (B)   Prohibiting the possession, sale and advertising of replica and facsimile firearms. Any person violating any of the provisions of §§ 133.020 through 133.028 shall upon conviction thereof be subject to a fine of not more than $500 or to imprisonment for a period of not more than 90 days or to both a fine and imprisonment, in the discretion of the court.

   (C)   Pistols. Any person found guilty of violating §§ 133.040 and 133.041 shall be guilty of a misdemeanor and shall be punished by a fine not to exceed $100 or imprisonment not to exceed 90 days and/or both a fine and imprisonment, in the discretion of the court.

   (D)   Blades. A person who violates §§ 133.055 through 133.059 is, pursuant to MCL § 750.227, guilty of a felony, punishable by imprisonment for not more than five years, or by a fine of not more than $2,500.
