§ 100.67 FAILURE TO COMPLY; CONSTRUCTION OR REPAIR BY CITY.
   (A)   In case any company shall fail or refuse to comply with the requirements of a resolution of the Common Council ordering the new construction or repair of a sidewalk, the City Engineer shall notify the Street Commissioner of the failure or refusal, and the Street Commissioner shall, as soon as practicable, make the new construction or repairs specified and required in the resolution under the direction of the City Engineer and to his satisfaction and acceptance. In the event the Street Commissioner does not have the necessary personnel or equipment available to make the new construction or repairs, the City Engineer with the approval of the Board of Works may, in accordance with the law, assign the work to a private contractor.
   (B)   The Street Commissioner shall report to the Common Council the costs of the new construction or repair in detail, giving the name of the owner and a description of the street or sidewalk crossing liable therefor and the amount for which each is chargeable, and the certificate of the City Engineer attached showing that the work has been properly done and brought to the established grade.
