§ 93.061 CONSTRUCTION AND LOCATION STANDARDS.
   (A)   Prior to the construction of a temporary fireworks stand, the owner thereof or the person proposing to do business therefrom shall obtain an appropriate building permit therefor from the office of the city’s Building Commissioner pursuant to §§ 150.025 and 150.040.
   (B)   (1)   Each fireworks stand from which fireworks are dispensed within the city shall be a substantial, 4-sided structure with a solid roof, which shall be self-supporting and capable of carrying its own weight.
      (2)   Construction shall be by 2 x 4s on 24-inch centers (or equal), sided with 3/8-inch plywood (or equal). The minimum size for a fireworks stand shall be four feet deep by 8 feet wide by 7 feet tall. Each fireworks stand shall have at least 1 regular manufactured door with appropriate hardware for ingress and egress (in addition to any open counter area).
      (3)   The location of each stand must comply with all applicable zoning laws of the city, including setback requirements. No fireworks stand shall be permitted within 25 feet of either corner property line for locations at street intersection corners. While state law prohibits the sale of fireworks at retail from trucks, vans or automobiles, fireworks may be sold at retail within the city from a carnival type trailer only in lieu of a stand; provided that, the trailer has a counter area and a separate door for ingress and egress.
      (4)   In addition, the trailer must meet any other minimum requirements of this chapter. House type trailers will not be permitted for retail sales usage in lieu of a stand.
   (C)   Before business may be conducted from it, the structure or trailer must be inspected and approved by the city’s Building Inspector and Fire Prevention Bureau.
