720.01 DEFINITIONS.

   For the purpose of this chapter the words and phrases in the sections hereunder shall have the same meanings respectively ascribed to them as set out in Ohio Revised Code Chapter 3796, unless a different meaning is clearly indicated by the context.

720.02 CULTIVATORS, PROCESSORS AND RETAIL DISPENSARIES OF MEDICAL MARIJUANA PROHIBITED.

   No cultivator, processor, or retail dispensary of medical marijuana licensed under Ohio Revised Code Chapter 3796 shall operate within the City of Hamilton.

720.03 VIOLATIONS.

   The City may institute, in any court of competent jurisdiction, an action to prevent, restrain, correct or abate any violation of this chapter. The court shall adjudge to the City such relief, by way of injunction, which may be mandatory, or otherwise, as may be proper under all the facts of and circumstances of the case, in order fully to effectuate the purpose of this chapter and the prohibitions permitted pursuant to Ohio Revised Code Section 3796.29.

720.99 PENALTY.

   Whoever violates any of the provisions of this chapter shall be deemed guilty of a misdemeanor in the third degree. Each day the violation continues shall be considered a separate offense.
